These Terms of Service (“Terms”) govern your access to and use of the Hyppot software (“Software”) during the open beta period. By installing, copying, or otherwise using the Software, you agree to be bound by these Terms.

License and Eligibility

Open Beta License

During the open beta period, the Software is provided free of charge upon approval of a license application. You may use the Software after receiving a valid license key from us.

Eligibility

You must be legally able to enter into these Terms and have the authority to bind the entity on whose behalf you are using the Software.

Beta Disclaimer

You understand and acknowledge that:

The Software is in an open beta stage and may contain bugs, errors, or other unexpected behavior.

It is provided for real-world use, including production environments, but we do not guarantee that the Software is free of defects or will function as intended in all use cases.

You are solely responsible for evaluating the suitability of the Software for your use.

Ownership and Restrictions

Intellectual Property

Hyppot and all associated intellectual property rights remain the exclusive property of the developers. You are granted a non-exclusive, non-transferable, revocable license to use the Software.

Restrictions

You agree not to:

Sell, rent, sublicense, or distribute the Software;

Circumvent or disable any license or access control mechanisms.

Modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit the Software in whole or in part except as expressly authorized by the developers.

"As Is" Disclaimer

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. USE OF THE SOFTWARE IS AT YOUR OWN RISK.

IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
